13.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.

13.2 Binding Arbitration

The arbitration shall be conducted in the English language. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could order or grant, including injunctive relief and attorney's fees, where authorized by law.

13.3 Class Action Waiver

YOU AND ROUND TABLE PIZZA EACH AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR IN COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION. You agree that you may bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator shall have no authority to consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.

13.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information, pending resolution of the dispute through arbitration.

14. Term and Termination

Round Table Pizza shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, fires, floods, earthquakes, government actions, civil unrest, strikes or labor disputes, supply chain disruptions, power outages, or failures of telecommunications or internet infrastructure. In such events, we will make reasonable efforts to resume performance as soon as practicable.

19. Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may freely assign our rights and obligations under these Terms to any affiliate, successor, or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets, without restriction or your consent.
